Delta Airlines Flight Delay Compensation — EU261 Applies for EU Departures

Delta Air Lines (IATA: DL) is the world's largest airline by passengers. As a US carrier, EU Regulation 261/2004 applies only for flights departing from EU or UK airports. London Heathrow–New York on Delta? Covered. New York–London on Delta? NOT covered. You may be owed up to €600 per person for delays of 3+ hours.

KLM codeshare — check your boarding pass

Delta and KLM operate many transatlantic routes as codeshares. If your ticket has a KL (KLM) flight number but Delta is the operating carrier, Delta is liable under EU261. If your ticket has a DL (Delta) flight number but KLM is operating, KLM is liable. Always check who operated your flight — it's on your boarding pass.

All Delta transatlantic routes from Europe qualify for €600 (over 3,500 km). Delay of 3+ hours at final destination required. Cancellations with less than 14 days' notice also qualify.

Delta common denial tactics

  • "EU261 doesn't apply to American carriers" — false for EU/UK departures; all carriers operating from EU soil are bound by EU261
  • "Your New York departure is not covered" — correct, but your EU outbound leg is. Only file for the EU-departure flight
  • "The delay was due to weather" — weather can be extraordinary circumstances, but only if it directly caused your specific flight's delay and Delta took all reasonable measures
  • "Technical issue was extraordinary circumstances" — technical faults in the aircraft are Delta's responsibility; courts routinely reject this defence
  • Spain passengers: Delta operates from Madrid — Spain's 1-year deadline applies, file within 12 months of the flight
  • Codeshare confusion: if your DL-branded ticket was operated by KLM, direct your claim to KLM (the operating carrier)
